Section 1 – Your Acceptance
These Terms and Conditions (“Terms”) apply to all sales made by JoyPouch, Inc. (“we”, “us”, “our”) through joypouch.com (the “Site”). “You” or “customer” refers to the user or purchaser.
By using the Site or purchasing products, you agree to be bound by these Terms, including any policies referenced herein. We may update these Terms from time to time by posting changes on the Site. Continued use of the Site after changes constitutes acceptance, unless otherwise required by applicable law.
Section 2 – Your Representations
By agreeing to these Terms, you confirm that you are of legal age (21+ in the US or as required in your jurisdiction) to purchase nicotine products. You agree that products purchased are for personal use only and not for resale. You acknowledge that products may contain nicotine, an addictive chemical, and should only be used in accordance with applicable law and medical advice.
Section 3 – Age Verification
Products are sold strictly to adults of legal age in their jurisdiction. We may use third-party services or request government-issued identification to verify age. If verification is not successful, orders will be cancelled. Some jurisdictions may also require adult signature upon delivery.

Some products are available only online and may have limited quantities. Returns and exchanges are handled according to our Returns Policy. We strive to display product information accurately, but cannot guarantee that device displays reflect colors precisely. We may restrict the sale of certain products in jurisdictions where they are not permitted.
Section 7 – Product Safety
Use products only as directed. Products may contain nicotine, which is addictive. Do not use if you are pregnant, breastfeeding, or have health conditions such as heart disease, hypertension, or asthma. Stop use and consult a physician if you experience adverse effects. Section 8 – Billing and Account Information
You must provide accurate and complete billing, shipping, and contact information. Failure to do so may result in order delays or cancellations. We are not responsible for issues caused by inaccurate information, except as required by law.
Section 9 – Payments
We accept Visa, MasterCard, American Express, Discover, Diners Club, and JCB where available. Payments are securely processed in USD, and you will be charged the total shown at checkout.
Section 10 – Order Acceptance
An order confirmation acknowledges receipt but does not guarantee acceptance. We may refuse or cancel orders, limit quantities, or request additional information if needed. If your order is cancelled after payment, a refund will be issued.

Destinations: United States, Canada, United Kingdom (availability may vary by product and law).
Estimated Time: 3–7 working days after dispatch.
Delivery times are estimates only. Some regions may require adult signature or ID verification on delivery. Shipping fees (if applicable) are displayed at checkout.
Section 12 – Lost Shipment
Please ensure your shipping address is complete and accurate. If an incorrect address results in non-delivery, we are not obligated to replace or refund. If the carrier marks a package delivered but you have not received it, notify us within 7–10 working days so we can assist in investigating with the carrier. Outcomes may vary depending on investigation results and applicable law. Remedies (replacement or refund) will be provided as required by law.
Section 13 – Disclaimer of Warranties; Limitation of Liability
Except as required by law or expressly stated by us, products are provided “as is.” To the extent permitted by law, we disclaim all implied warranties including merchantability and fitness for purpose. Nothing in these Terms excludes rights you may have under consumer protection laws that cannot be waived.
To the extent permitted by law, our liability for any claim shall not exceed the amount paid for the product giving rise to the claim. We are not liable for indirect or consequential damages (such as lost profits), except where such exclusion is not permitted by law.
Section 14 – Indemnification
You agree to indemnify and hold harmless JoyPouch, Inc. and affiliates from claims arising from your breach of these Terms, unlawful use of products, or violation of rights, except where limited by applicable law.
Section 15 – Intellectual Property
All intellectual property on the Site is owned by JoyPouch, Inc. or its affiliates. You may not use or reproduce such property without prior written consent, except as expressly allowed under these Terms or applicable law.
Section 16 – Severability
If any provision of these Terms is found invalid or unenforceable, the remainder shall remain in effect to the fullest extent permitted by law.
Section 17 – Force Majeure
If we are unable to perform obligations due to force majeure (events beyond our control, such as natural disasters or strikes), performance may be suspended. If performance becomes permanently impossible, the affected order may be cancelled without liability, except that your statutory rights remain unaffected.
Section 18 – Non-Waiver; Entire Agreement
Failure to enforce any provision does not waive our rights. These Terms, together with policies referenced herein, constitute the entire agreement between you and us and supersede prior agreements, except where not permitted by law.
Section 19 – Arbitration
Where permitted by law, disputes shall first be attempted to be resolved informally. If unresolved within 60 days, disputes may be submitted to binding arbitration under JAMS rules, in Las Vegas, Nevada, unless otherwise agreed. To the extent permitted by law, you and we waive rights to jury trial and class actions. If such waiver is not enforceable in your jurisdiction, your statutory rights remain unaffected.
Section 20 – Governing Law; Forum Selection
These Terms are governed by the laws of Nevada, USA, except as overridden by mandatory consumer protection laws in your jurisdiction. Disputes shall be resolved in Nevada courts, subject to applicable law. The Federal Arbitration Act governs arbitration. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
